建设工程合同管理规范化研究
                        

摘  要

在社会主义市场经济体制中，建筑活动主要是通过建筑市场实现的,其中建筑工程合同是维系市场运转的载体。建设工程合同是承发包双方为实现建设工程目标，明确相互责任、权利、义务关系的协议，是承包人进行工程建设并获取合理利润的源泉，同样也是发包人支付价款，控制工程项目质量、进度、投资，进而保证工程建设活动顺利进行的重要法律文件。加强合同管理是保证承发包人全面履行合同约定的义务，是确保实现建设目标(质量、投资、工期)的重要手段。
    本论文对建设工程合同管理等概念进行了解释，并通过对建筑工程合同的发展与现状的论述，对建设工程合同管理的目的、任务等进行了详细分析，阐明了建设工程合同管理规范化的内涵，对建设工程合同管理进行了简要介绍。然后在上述理论的基础上，就目前我国建设工程合同管理存在的主要问题，经过综合对比分析，归纳出的产生问题的主要原因，并对问题存在的深层次原因进行了分析，提出了相应解决措施，解决了索赔难问题。最后对国内国际建设工程合同管理进行了比较借鉴，从宏观调整与控制、微观操作等方面提出了相应的建设工程合同管理规范化建议。

Abstract 

In the socialist market economic system, the construction activity is mainly achieved through the construction market, including construction contract is to maintain the operation of markets carrier. Construction Procurement contract construction projects for the realization of both goals, a clear mutual responsibilities, rights and obligations of the agreement, is the contractor for construction and the source of a reasonable profit, is also contracted to pay the price, control the project quality, progress , investment, thus ensuring the smooth progress of construction activities, an important legal document. Strengthening Procurement Contract Management is to ensure people fully fulfill their contractual obligations, is to secure a building objectives (quality, investment, construction period) is an important means.
    This thesis on construction contract management, explained the concept and development through the construction contract and the status of discourse on the construction project contract management purposes, tasks are analyzed in detail, explained the construction contract management standardization of content of construction contract management are briefly introduced.  Then the theory based on the construction contract on the management of our country's major problems exist, through comprehensive analysis, we summarize the main production problems, and problems of deep-seated reasons were analyzed, the corresponding solutions proposed to solve the difficult problem claims.Finally, domestic and international construction project contract management compared draw, from the macro adjustment and control, micro-operation, set the appropriate construction contract management standardization proposal.
